The United States Citizenship and Immigration Service (USCIS) has announced a new version of Form I-9 (I-9) to become available on August 1, 2023, from the USCIS website.
New I-9 Form
The I-9 form will still be used to verify employees' identity and employment authorization; however, it includes some significant revisions.
- The I-9 instructions are simplified and reduced to only eight pages from the current 15.
- Sections 1 and 2 of the form are now just a single-sided sheet of paper.
- New check-boxes for employers to indicate I-9 examined documents remotely under the new alternative procedure (rather than by physical examination).
- Form I-9 will be available as a 'fillable form' that can work on mobile devices (phones, tablets, etc.).
- Re-verification and Rehire sections are now a stand-alone supplement for use only when needed.
- Revisions to the Lists of Acceptable Documents
- Section 1 Preparer/Translator Certification is now a stand-alone supplement for use only when needed.
- Guidance and links to information on automatic extensions of employment authorization documentation.
August 1, 2023, begins a transitional period in which either the current or new I-9 can be used; however, the new I-9 form must be used starting November 1, 2023.
New Alternative Procedure for Qualified Employers
A new alternative procedure is part of the revisions and begins on August 1, 2023. This new procedure is an alternative to the actual in-person physical document examination that employers have followed as part of the I-9 process. This alternative procedure is only available to employers enrolled in E-Verify.
